ARTICLE 1 — PURPOSE
These General Terms and Conditions of Sale ("GTCS") govern all sales concluded on the website www.maisonzokarparis.com between Maison Zokar Paris and any adult natural person acting as a consumer (hereinafter "the Client").
Any order placed on the website implies full and unreserved acceptance of these GTCS, which are binding on the Client in accordance with Article L221-1 of the French Consumer Code.
ARTICLE 2 — SELLER IDENTIFICATION
The website www.maisonzokarparis.com is published and operated by the French branch of Maison Zokar Incorporated, hereinafter referred to as "Maison Zokar Paris" or "the Seller".

ARTICLE 3 — PRODUCTS
Maison Zokar Paris sells niche fragrances, presented with their essential characteristics (composition, capacity, concentration). The photographs illustrate the products as faithfully as possible, without engaging the Seller's liability in the event of chromatic variation due to the Client's screen.
Products are offered subject to availability. In case of unavailability after an order is placed, the Client will be informed and refunded as soon as possible.
ARTICLE 4 — ORDER
The order is validated by the Client after confirmation of their basket, entry of delivery and billing details, choice of payment method, and acceptance of these GTCS.
Maison Zokar Paris reserves the right to refuse or cancel any order that is abnormal, fraudulent, or contrary to these GTCS.
A confirmation email will be sent to the Client at the address provided during the order.
ARTICLE 5 — PRICE
Prices are indicated in euros (€) all taxes included for deliveries to Mainland France and the European Union. For deliveries to Canada, prices are indicated in Canadian dollars (CAD$) excluding taxes, with applicable federal and provincial taxes (GST, HST, QST or PST, depending on the destination province) added at the time of basket validation in accordance with Canadian tax legislation.
Shipping costs are specified before final order validation.
Maison Zokar Paris reserves the right to modify its prices at any time, it being understood that the applicable price is the one in force at the time of order validation.
ARTICLE 6 — PAYMENT
Payment is due immediately upon order. Accepted payment methods are specified on the website (Visa, Mastercard, American Express bank cards, as well as payment solutions offered by Shopify Payments).
Transactions are secured by SSL encryption. Maison Zokar Paris does not store any of the Client's banking data.
The order will be processed after effective payment validation.
ARTICLE 7 — DELIVERY
Areas served: Mainland France, European Union, Canada.

- Canada: Canada Post
Delivery times (from dispatch):
- Europe (France and EU): 2 to 5 business days
- Canada: 2 to 6 business days
Shipping costs: complimentary delivery on any order equal to or greater than €150 (Europe) or CAD$150 (Canada). Below this amount, costs are specified at the time of ordering.
Delivery times are indicative. Any reasonable delay in delivery cannot give rise to damages or cancellation of the order, except in application of Article L216-2 of the French Consumer Code (prior formal notice).
In the absence of the recipient, a delivery notice will be left, allowing the package to be collected according to the carrier's terms.
The risk of loss or damage is transferred to the Client upon effective delivery of the package (Article L216-4 of the French Consumer Code).
ARTICLE 8 — RIGHT OF WITHDRAWAL
In accordance with Article L221-18 of the French Consumer Code, the Client has a period of fourteen (14) clear days from receipt of the product to exercise their right of withdrawal, without having to provide reasons or pay a penalty.
To exercise this right, the Client sends written notification to contact@maisonzokarparis.com specifying: surname, first name, order number, and clear indication of the wish to withdraw.
Exceptions to the right of withdrawal: in accordance with Article L221-28 of the French Consumer Code, the right of withdrawal cannot be exercised for sealed products that cannot be returned for reasons of hygiene or health protection and that have been unsealed after delivery. Unsealed fragrance bottles (cellophane removed) therefore cannot be returned.
Products must be returned intact, in their original packaging, unused and sealed, within a maximum period of fourteen (14) days following notification of withdrawal. Return shipping costs are borne by the Client.
Reimbursement occurs within a maximum period of fourteen (14) days following receipt of the products by Maison Zokar Paris, by the same payment method used for the order.
ARTICLE 9 — RETURNS AND REFUNDS
In addition to the exercise of the right of withdrawal provided for in Article 8, any product received damaged, defective, or not conforming to the order must be reported to contact@maisonzokarparis.com within seven (7) days of receipt, accompanied by supporting photographs.
After verification, Maison Zokar Paris will proceed, at the Client's choice, to a replacement, a credit note, or a full refund, including shipping costs.
ARTICLE 10 — LEGAL GUARANTEE OF CONFORMITY
In accordance with Articles L217-3 et seq. of the French Consumer Code, the Client benefits from a legal guarantee of conformity of two (2) years from the delivery of the product. The Client may request that the goods be brought into conformity through repair or replacement, free of charge.
The Client is exempted from proving the existence of any lack of conformity of the goods during the twenty-four (24) months following their delivery.
ARTICLE 11 — GUARANTEE AGAINST HIDDEN DEFECTS
In accordance with Article 1641 of the French Civil Code, Maison Zokar Paris guarantees the Client against hidden defects rendering the product unfit for its intended use, under the conditions provided for in Articles 1641 to 1648 of the French Civil Code.
The Client may choose between cancellation of the sale or a reduction in the sale price. This action must be initiated within two (2) years from the discovery of the defect.
ARTICLE 12 — INTELLECTUAL PROPERTY
All elements of the website (texts, photographs, illustrations, brands, logos, visual identity, fragrance formulas) are the exclusive property of Maison Zokar Paris or its partners. Any reproduction, representation, modification, or exploitation without prior written authorisation is prohibited and constitutes an infringement punishable by the French Intellectual Property Code.
ARTICLE 13 — PERSONAL DATA
The processing of the Client's personal data is governed by the Privacy Policy accessible on the website, in accordance with the General Data Protection Regulation (GDPR) and the French Data Protection Act (Loi Informatique et Libertés).
ARTICLE 14 — LIABILITY
Maison Zokar Paris cannot be held liable for indirect damages resulting from the use of the products, nor for damages caused by use that does not comply with recommendations.
Its liability cannot be engaged for any damage resulting from a case of force majeure, from the Client's actions, or from the unforeseeable and insurmountable act of a third party.
ARTICLE 15 — FORCE MAJEURE
Maison Zokar Paris cannot be held liable for the non-performance or late performance of its obligations in the event of force majeure as defined by French case law.
ARTICLE 16 — MEDIATION AND DISPUTE RESOLUTION
In accordance with Article L612-1 of the French Consumer Code, the Client has the option, in the event of a dispute with Maison Zokar Paris not resolved amicably, to resort free of charge to a consumer mediator.

ARTICLE 17 — APPLICABLE LAW AND JURISDICTION
These GTCS are subject to French law.
In the absence of an amicable resolution, any dispute will be brought before the competent courts of Paris, subject to mandatory provisions applicable to consumers.
ARTICLE 18 — MODIFICATION OF THE GTCS
Maison Zokar Paris reserves the right to modify these GTCS at any time. The GTCS applicable to any order are those in force at the time of its validation.
